Terms of Service
These terms and conditions apply to the Red Pen app (hereby referred to as "Application") for mobile devices that was created by Red Labs s.r.o. (hereby referred to as "Service Provider") as a Freemium service. By using or downloading the Application, you agree to be bound by these Terms of Service.
The Service Provider reserves the right to modify or terminate the Application or the Service at any time, with or without notice, and for any reason, including termination of accounts, removal of content, or withdrawal of paid features. Payments made for the Service are non-refundable, including in cases of termination without cause.
The Service Provider may change the Application or charge for its services at any time. Any fees charged will be clearly disclosed within the Application or on its website prior to purchase.
The Application stores and processes personal data that you provide in order to deliver the Service. You are responsible for maintaining the security of your device and your access credentials. Jailbreaking, rooting, or modifying your device in ways not intended by the manufacturer may compromise security and functionality and is done entirely at your own risk.

Some features of the Application require an active internet connection. The Service Provider cannot be held responsible if the Application fails to function due to a lack of connectivity or depleted data allowances. You are responsible for any data or roaming charges incurred while using the Application.
The Service Provider is not responsible for any issues arising from your use of the Application, including device malfunction, low battery, or inability to access the Service.
While the Service Provider strives to keep the Application accurate and up-to-date, it relies on third-party information and services. The Service Provider is not liable for any direct or indirect losses resulting from the use or reliance on the Application.
User-Generated Content and Intellectual Property
By submitting, creating, uploading, or otherwise making available any content, data, text, images, or materials (“User Content”) through the Application, you acknowledge and agree that:
- All such User Content shall automatically and irrevocably become the sole property of Red Labs s.r.o. upon creation or submission.
- You hereby assign to Red Labs s.r.o. all rights, title, and interest, including all intellectual property rights, in and to such User Content, without any further action or compensation.
- Red Labs s.r.o. shall have the unrestricted right to use, reproduce, modify, adapt, publish, translate, distribute, and create derivative works from such User Content in any media, for any purpose, commercial or otherwise.
- You waive any moral rights or rights of attribution to the extent permitted by applicable law.
- You represent that the User Content is original to you and does not infringe upon any third-party rights.
The Service Provider reserves the right to suspend or terminate your access to the Application or Service at any time and for any reason, including, but not limited to, violation of these Terms, inactivity, or at the Service Provider’s sole discretion. Upon termination, all rights granted to you under these Terms will immediately cease. Any fees paid for the Service are non-refundable.
Limitation of Liability
To the maximum extent permitted by law, Red Labs s.r.o. shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of data, profits, or business opportunities, arising out of or in connection with the use or inability to use the Application, even if advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless Red Labs s.r.o., its directors, employees, and affiliates from and against any claims, damages, liabilities, losses, and expenses arising out of your use of the Application, your User Content, or your violation of these Terms.
Changes to These Terms
The Service Provider may revise these Terms from time to time. You are encouraged to review this page periodically. Continued use of the Application after any modification constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Slovak Republic. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Slovak Republic. However, the Service Provider retains the right to enforce its rights or seek remedies in any competent jurisdiction worldwide.
These Terms and Conditions are effective as of 2025-01-01.
